The petitioner has filed this writ petition seeking following reliefs:- “10.1 That, this Hon'ble Court may kindly be pleased to call for the entire records pursuant to the case of petitioner. 2 10.2 That, this Hon'ble Court may kindly be pleased to consider the case of petitioner for promotion to the post of Assistant Class - III from Class – IV employee with all consequential benefits.. 10.3 Any other relief, which Hon’ble Court deems fit and proper may also kindly be granted to the petitioner in the interest of justice.” 2. Learned counsel for the petitioner submits that the petitioner was appointed as a Labourer under the work-charge and contingency establishment on compassionate basis vide order dated 14.01.2009. He submits that the respondent authorities are not promoting the petitioner on the post of Lower Division Clerk (Class – III) from the post of Labourer (Class – IV) employee and therefore, he may be permitted to submit a comprehensive representation before the Respondents No. 2 & 3 and direction be issued to the Respondents No. 2 & 3 to take decision on the representation to be submitted at the earliest. 3. On the other hand, learned counsel for the Respondents/State would submit that as the petitioner is not pressing this writ petition on merits and is only seeking a direction to the concerned authorities to take decision on the representation to be submitted by the petitioner, he is having no objection to the limited prayer. 4. I have heard learned counsel for the parties and perused the documents placed on record. 5. On due consideration of the submission of counsel for the respective parties, facts and circumstances of the case, nature of grievance raised by the petitioner, without entering into the merits of the claim of petitioner, this writ petition at this stage is disposed of permitting the petitioner to submit a fresh representation before the Respondents No. 2 & 3 and if such a representation is submitted by the petitioner, concerned authority shall consider and take decision on the representation to be submitted by the petitioner on its own merits in accordance with law, expeditiously, 3 preferably within a period of 02 months from the date of receipt of representation. 6.
