(2 of 3) [CRLMB-1176/2026] Criminal Misc. Bail Application No. 12947/2024 respectively and the case of petitioner is not different from that of the co-accused.
Learned counsel also submits that the petitioner is in custody since long; charge-sheet has already been filed in the matter and no recovery is required to be made against the petitioner. Learned Counsel further submits that the trial of the case will take considerably long time, so no fruitful purpose would be served by keeping him in custody, and therefore, prays that the petitioner may be granted the benefit of bail under Section 483 of B.N.S.S.
3. Per contra, learned Public Prosecutor vehemently opposes the submissions made by the learned counsel for the petitioner hereinabove and also contended that seven other criminal cases have already been registered against the petitioner.
4. Taking into consideration the overall facts and circumstances of the case; the arguments advanced by learned counsel for the petitioner, the facts that charge-sheet has been filed; co-accused namely Naresh, Ravi and Bantu have already been enlarged on bail by this court; trial will take considerably long time in its conclusion, thus, without commenting anything on merits / demerits of the case, this Court deems it just and proper to enlarge the petitioner on bail.
