Petitioner has filed this writ petition stating that he was not given benefit of First Time Scale Pay while they were in service, he has submitted representation dated 21.08.2023 (Annexure-P/9), however, the same was not considered. He also contended that similarly situated employees have filed writ petitions bearing WPS No. 9642, 6169, 5229, 5234, 2772, 2656, 2788, 2774, 4130, 164, 231 of 2024 and in those cases, State has come with reply that the claim of those petitioners will be reviewed by the Department and the review proceedings is pending consideration. It is contention of counsel for the petitioner that the respondent-State be directed to review the claim of petitioner along with other petitioners named in the aforementioned petition. 2. Counsel for the respondents-State submits that in view of the reply filed by the State and stand taken in the writ petitions as mentioned above, she is having no objection to the limited prayer. 3 / 3. Perusal of the reply submitted by the State in WPS No. 6169 of 2024, would show that the State Government has taken the stand that the claim of the petitioner therein have to be examined for their eligibility for extending the benefit of Time Pay Scale. Relevant Para are extracted below for ready reference: “2. That, alongwith identical and connected matters, the present case was listed before the Hon'ble Court for hearing on 07/01/2026 and observing that initially the petitioners were appointed as Forester in the year 1971-79 and they were notionally promoted as Deputy Ranger in pursuance of the order dated 07/03/2018 passed in WPS NO. 4765/2005 and thereafter they have been promoted as Ranger with effect from 1996 and no promotion thereafter was granted to them and therefore, they raised their grievance with regard to time bound pay scale as per the policy framed by the State vide Annexure P/4 dated 28/04/2008 which provides that the benefit of the scheme will be applicable to the government servants who have already been promoted once, twice or more than twice, still they are entitled to get the benefit of Time Scale Pay Scheme 2006 dated 28/04/2008 and Clause V of the said policy provides that the benefit of the scheme will be applicable from 01/04/2006, the Hon'ble Court vide order dated 07/01/2026 was pleased to direct the State to re- examine the matter keeping in view of the policy dated 28/04/2008 and examine the case of the petitioners with regard to their eligibility criteria, ACR and other required conditions which are necessary for grant of time pay scale and file an affidavit in the matter. 3. It is respectfully submitted that there are total 356 Rangers who were granted promotion with effect from 26/06/1996 and as of now, all 356 Rangers already stood retired from service on attaining the age superannuation. It is submitted that while they were in service, they were posted in various places / offices of the Department of Forests across the State of 4 / Chhattisgarh. It is respectfully submitted that in order to assess their eligibility required for the benefit of time pay scale, the service records of all 356 Rangers have to be examined /scrutinized in light of the order dated 22/08/2008 by which the Department of Forest has floated the scheme of 4 level time pay scale for the employees holding the post of Ranger with effect from the date of issuance of the said order and the circular dated 28/04/2008 issued by the Department of Finance as well as in light of the order dated 22/02/2018 passed by Hon'ble M.P. High Court in WP No. 4717/2001. 4. It is respectfully submitted that the cases of all 356 Rangers are, as of now, under scrutiny which may take some time of about two and three months so that appropriate decision with respect to the entitlement of all the petitioners for the benefit of time pay scale can be taken in accordance with the applicable scheme/circular isssued by the competent authority.” 4. On due consideration of submissions made by learned counsel for parties, the writ petition is disposed of at this stage, permitting the petitioner to submit a fresh comprehensive representation, raising all the grounds with all supporting documents before Respondent No. 2 to 4 and if such a representation is submitted, the concerned authorities shall consider and taken decision on the claim of the petitioner also, along with the claim of other petitioners in the aforementioned writ petitions. 5.
