Bareth, PL Hon’ble Shri Justice Sachin Singh Rajput Order on Board 02/02/2026 This writ petition has been filed by the petitioner claiming following reliefs : 10.1 That, this Hon'ble Court may kindly be pleased to call for entire records regarding present case from Courts below. 10.2 That this Hon'ble Court may kindly be please to set- aside the order dated 13.11.2025 passed by the learned 4th 3 Civil Judge Senior Division Bilaspur, District Bilaspur (C.G.) in Execution Case No. 534/2010, parties "Kiran Kumar & others Vs. Rajkumar & others" (Annexure-P/1) and further be please to direct to the learned Executing Court i.e. First Additional Judge to the Court of First Civil Judge Senior Division Bilaspur, District Bilaspur (C.G.) to ensure the execution of judgment and decree dated 23.03.2007 and handed over the possession of the question land after partition upto 1/9 shares of the petitioners/decree holders within stipulated time, is in the interest of justice. 10.3 That, any other relief/order which may deem fit and just, in the facts and circumstances of the case including award of the costs of the petition may be given. 2. Learned counsel for the petitioner submits that the learned 3rd Civil Judge Class-I, Bilaspur, CG in Civil Suit No. 12-A/2006 passed the judgment and decree of declaration which reads as under:- क) वादीगण, ्ቚति वादी ्ቅाሰक 1 वारेन््ቖ क ाሰरे क उतिाሰलाबाई से उत्प्ቐ से न है । ख) ्ቚत्येक वादी ቇኋाሰ चाटीडीहै तिबालासेपरे ቝኌ)* भू,तिाሰ ख०न० 167/10 ቌኔ्ቔफला0 -70 एकड़ भू,तिाሰ ाሰ3 से 1/9 तिहै)से बाटीवारे करे करे कब्जा ्ቚ्቎ करेन क अधि9करे है ।- (ग) ्ቚत्येक वादी जा,न तिबालासेपरे ቝኌ)* भू,तिाሰ खसेरे नम्बारे 157/1,161/1,164/1,164/10 एवा काሰቦቐ< ቌኔ्ቔफला 1 - 34 एकड़ भू,तिाሰ ाሰ3 से 1/9 तिहै)से क बाटीवारे करेकरे कब्जा ्ቚ्቎ करेन क अधि9करे है । घ) ्ቚति वादी ्ቅाሰक । से 6 )वाये क एवा वादीगण क भू वादी व्येये वाहैन करेग3। घ) अधि9वाሹኋ ቦቐल्क ्ቚाሰतिण हैAन परे ्ቚाሰण प्ቔ अनसेरे अ*वा अनसे,चा अनसेरे जाA भू न्ये,न हैA, वादीव्येये ाሰ3 जाAቦቐ जावा। 3. Thereafter, the respondents preferred an appeal before the First Appellate Court, i.e., the learned 9th Additional District Judge (FTC), Bilaspur, Chhattisgarh. The learned First Appellate Court vide its judgment dated 19.12.2008 passed in Civil Appeal No. 02-A/2008, dismissed the 4 appeal preferred by the respondents. Against the said judgment, no further proceedings were initiated by the respondents. The petitioner thereafter filed an execution application for enforcement of the judgment and decree dated 19.12.2008; however, till date, the same has not been taken to its logical conclusion. Thus, learned counsel for the petitioner submits that the learned Executing Court may be directed to conclude the execution proceedings expeditiously, in the light of the law laid down by the Hon’ble Supreme Court in case of Rahul S. Shah v. Jinendra Kumar Gandhi & Others reported in (2021) 6 SCC 418. 4. Having considered the limited prayer made by Mr. Agrawal, the instant petition is disposed of with a direction to the learned Executing Court to make all endeavors to conclude the execution proceedings keeping in mind the judgment passed by the Hon’ble Supreme Court in the matter of Rahul S.
