Learned A.G.A. has filed compliance affidavit today, which is taken on record. Shri Deshraj Garg, learned counsel for the applicant and Shri Tej Bhan Singh, learned A.G.A. for the State are present. The present application under Section 528 of Bhartiya Nagrik Suraksha Sanhita, 2023 has been filed by the applicant to quash the entire proceedings of Special Case No. 1422 of 2025, arising out of case crime No. 35 of 2025, under Sections 64, 351(3), 352, BNS, Section 3/4 of Protection of Children from Sexual Offences Act and Section 3(2)(v), 3(1)(da), 3(1)(dha) of Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, Police Station- Sikariganj, District Gorakhpur as well as cognizance/summoning order dated 9.5.2025 and order dated 6.2.2026, whereby charge has been framed, pending in the court of Special Judge (POCSO Act)/Additional Sessions Judge, Court No. 1, Gorakhpur. Learned A.G.A. pointed out that statement of the first informant has been recorded before the trial court and the trial is at advance stage. After some arguments, learned counsel for the applicant does not want to press this application and the same may be dismissed as not pressed.
