ORAL ORDER Learned Additional Government Advocate takes notice for all the respondents. 2. The grievance of the petitioner, who is an ex-serviceman, is that his application filed in the year 2010 seeking a grant of 5 acres of land at Chammanahalli Village,

Kootgal Hobli, Ramanagara Taluk and District (now Bangalore South District) has not been considered by the respondent authorities. However, learned counsel points out to Annexure-G and submits one more ex-serviceman who filed an application subsequent to the petitioner has been granted lands in Survey No.254 of the same village. Learned counsel submits the said survey number consists of more than 250 acres, which were available for grant to ex-serviceman. However, no decision has been taken by the respondent-Deputy Commissioner till date and therefore, the prayer in the writ petition is to issue a writ of mandamus directing the respondent authorities to consider the application filed by the petitioner and pass necessary orders for the grant of 5 acres of land in Survey No.254 of Chamanahalli Village. 3.
Having regard to the facts narrated herein, this Court is of the considered opinion that respondent No.2- Deputy Commissioner, was duty bound to consider the application filed by the petitioner and by now, along with the other applicants, the petitioner also should have been granted lands. - 4 -

The writ petition is accordingly disposed of with a specific direction to respondent No.2-Deputy Commissioner, Bangalore South District and respondent No.4-Tahsildar, Ramanagara Taluk, Bangalore South District, to consider the application filed by the petitioner and grant the lands in accordance with law as expeditiously as possible and at any rate within a period of two months from the date of receipt of a copy of this order. Ordered accordingly. Learned Additional Government Advocate is permitted to file memo of appearance within a period of four weeks from today. Sd/- (R DEVDAS) JUDGE
