1. Petitioner has filed this writ petition seeking following reliefs:
“(i) That, this Hon'ble Court may kindly be pleased to call for the entire records pertaining to the present land acquisition. (ii) That, this Hon'ble Court may be pleased to quash the entire Land Acquisition proceedings in Land Acquisition No. 15-10/A-82 year 2010-11 village- Bemta, Tahsil-Tilda. (iii) That, this Hon'ble court may kindly be pleased set aside the letter dated 2/3/2017 (Annexure P/1). (iv) This Hon'ble Court may kindly be pleased to direct the respondents to initiate acquisition proceedings afresh in respect of petitioner's land. (v) That, this Hon'ble Court may be pleased to pass any other relief that this Hon'ble Court may please deem fit and proper.”

Learned counsel for the petitioner submits that land of the petitioner bearing kh. no.288/19 was subject matter of acquisition for purpose of construction of road. However, till date petitioner has not received any amount towards compensation as computed by Land Acquisition Officer. He contended that according to his instructions, compensation against land of petitioner has been awarded to some other person and it was orally informed that after taking back the said amount from that person, amount will be paid to petitioner later on. However, even after
3 / 4 lapse of more than 10 years amount of compensation is not paid to petitioner.

Learned counsel for the State submits that from documents enclosed along with writ petition in particular Annexure P-1 it is appearing that Land Acquisition Officer- cum- Sub Divisional Officer (R) wrote letter to petitioner on 02.03.2017 mentioning that part of his land bearing kh. No.288/19 admeasuring 350 square metre has been acquired and
directed him to submit relevant documents as mentioned therein for purpose of disbursement of amount of compensation. However, no document is enclosed along with writ petition to show that petitioner has submitted relevant documents pursuant to memo/letter dated 02.03.2017

Learned counsel for the petitioner submits that though in the writ petition there is no document enclosed to show that relevant document as asked for have been submitted by petitioner, however, according to his instructions, relevant documents have already been submitted by the petitioner.
5. I have heard learned counsel for the parties and also perused the documents annexed along with writ petition.
6. Claim of petitioner is that compensation in lieu of land acquired by respondent is not paid to petitioner. From Annexure P-1 it is reflecting that land owned by petitioner was subject matter of acquisition by Land Acquisition Officer bearing kh. no.288/19. Compensation is also computed and petitioner was directed to submit relevant document vide letter dated 02.03.2017. Petitioner has not enclosed any document to show that petitioner pursuant to letter Annexure P-1 had
4 / 4 submitted relevant documents before the Land Acquisition Officer enabling him to disburse the amount of compensation.

In the aforementioned facts of case, I am inclined to dispose of this writ petition at this stage, directing petitioner to submit relevant documents as mentioned in Annexure P-1 before respondent No.3 within a period of one month and in the event petitioner submits relevant documents as mentioned in Annexure P-1, respondent No.3 shall consider and pass necessary order with respect to claim of petitioner for compensation and its disbursement as mentioned in Annexure P-1 within a further period of 3 weeks from the date of receipt of documents.
8. With the aforesaid observation and direction, writ petition stands
