JUSTICE SHIVASHANKAR AMARANNAVAR ORAL ORDER This petition is filed by sole accused under Section 439 of Cr.PC/Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 praying to grant bail in SC No.5003/2024 (Crime No.12/2023 of Srimangala Police Station) registered for offences punishable under Sections 448, 354, 323, 307 of IPC pending on the file of the learned II Additional District and Sessions Court, Mudikeri, Sitting at Virajpet, 2. Heard the learned counsel for petitioner and the learned High Court Government Pleader for respondent/State. - 3 - HC-KAR NC: 2026:KHC:7105 CRL.P No. 16560 of 2025 3. The learned counsel for petitioner would contend that the petitioner has been granted bail at the crime stage. He appeared before the Committal Court and case has been committed to Sessions Court. The Sessions Court issued summons. The petitioner has not been secured. The Sessions Court issued summons and also notice to the sureties. The summons issued to petitioner returned un-served. Thereafter, NBW has been issued to the accused and notice to the surety. The NBW was returned as executed with an endorsement that the petitioner had gone to Assam. The surety was present before the Trial Court and submitted that petitioner is taking treatment in Madikeri. The petitioner has been secured by executing NBW on 12.09.2025 and since then he is in judicial custody. There is no service of summons by the Trial Court. The petitioner is a resident of Assam, his prayer for bail cannot be denied on that ground. It is submitted that the petitioner is how residing in an estate at Chikkamagaluru along with his family members. Considering the above aspects, the petitioner has made out a case for grant of bail with conditions. In the result, the following: ORDER i) The petition is allowed. ii) The petitioner is granted bail in SC No.5003/2024 (Crime No.12/2023 of Srimangala Police Station) registered for offences punishable under Sections 448, 354, 323, 307 of IPC pending on the file of the learned II Additional District and Sessions Court, Mudikeri, Sitting at Virajpet subject to following conditions. a) The petitioner shall execute a personal bond for a sum of Rs.1,00,000/- with one surety for the like sum to the satisfaction of the Trial Court. - 5 - HC-KAR NC: 2026:KHC:7105 CRL.P No. 16560 of 2025 b) The petitioner shall not tamper the prosecution witnesses either directly or indirectly. c) The petitioner shall attend the Trial Court on all dates of hearing and unless exempted and cooperate for speedy disposal of the case. d) The petitioner shall produce his address proof.
