Learned counsel appearing for the petitioners submits that the petitioners’ case is arising out of Specific Performance Act however, FIR has been lodged. He further submits that the allegations are made that the land has not been transferred in favour of the informant however, Rs.13,50,000/- has been taken by the petitioners. He further submits that good sense has been prevailed between the parties and the petitioners have already returned a sum of Rs.12,50,000/- to the informant. On these grounds, he submits that anticipatory bail may kindly be granted. 4. Learned counsel appearing for the State as well as learned counsel for the informant jointly oppose the prayer and submit that in spite of taking money, land has not been transferred in favour of the informant. 5.
