The petitioner, above-named, who is in custody in connection with Itkhori (Chatra) P.S. Case No.102 of 2019 for the offence registered under Sections 406, 407, 420, 34 of the Indian Penal Code. Informant of the case is the Assistant Engineer of the Electricity Department and the instant FIR has been lodged against altogether 17 named accused persons who were running Pragya Kendra and were delegated authority to receive the payment from consumers of the electricity bill for the Electricity Department. This petitioner is alleged to have misappropriated a sum of Rs.3,33,420/- which was received from the consumers, but was not deposited to the Electricity Department. It is submitted by the learned counsel on behalf of petitioner that the said default was not intentional and due to some computational error, the amount could not be deposited within the stipulated time. However, now the said amount has been deposited. Learned A.P.P. for the State while opposing the prayer for bail, but has not disputed the factual assertions made on behalf of the petitioner. Under the circumstances, the above-named petitioner is directed to be released on bail on furnishing bail bond of Rs.25,000/-(Twenty- Five Thousand) with two sureties of the like amount each to the satisfaction of the Court below.
