The petitioner is apprehending his arrest in connection with Balumath P.S. Case No. 127 of 2022, registered for the offence under Sections 407, 409 and 120B of the Indian Penal Code, pending in the court of learned Chief Judicial Magistrate, Latehar. 3. Learned counsel appearing for the petitioner submits that the petitioner has nothing to do with the articles which have been loaded on the truck and owner-cum-driver of the truck is Imran Khan. He submits that the said loaded articles have not reached the destination and for that the case has been lodged. He further submits that even the petitioner is not named in the FIR and now the petitioner has received the notice. He next submits that allegations are made that the mobile number used by Imran Khan was in the name of the petitioner however, the petitioner is not knowing that how the the said mobile number has come to the possession of Imran Khan, who is owner-cum-driver of the said truck. He also submits that the petitioner is having no criminal antecedent as disclosed in para 13 of the petition. 4. Learned counsel appearing for the State opposes the prayer and submits that the allegations are there and the mobile number of the petitioner was used by Imran Khan. 5. Considering that the main allegation is there against Imran Khan of taking the articles on the truck and not delivering the same on the destination and only allegation is made that petitioner’s mobile number was used by Imran Khan and petitioner is having no criminal antecedent as 2026:JHHC:16616 disclosed in para 13 of the petition, in the attending facts and circumstances, I am inclined to grant anticipatory bail to the petitioner. 6. Accordingly, the above-named petitioner is directed to surrender before the learned court within two weeks from today and in the event of his arrest or surrender, he shall be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Latehar, in connection with Balumath P.S. Case No. 127 of 2022, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. (Sanjay Kumar Dwivedi, J.) Anit Uploaded 11.06.2026
