2 Dr. YLR, J W.P.No.3025 of 2026 Dated 11.02.2026
The Court made the following: ORDER:
The Writ Petition has been filed for the following relief: <…to issue an appropriate Writ, Order or Direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondents to marking the lien over her A/c.No.0093104000211956 is illegal, arbitrary and without jurisdiction and consequently direct them to forthwith remove the lien on my account to enable me to do my regular transactions…=
2. Heard the learned counsel for the petitioner and the learned Assistant Government Pleader. 3. Sri P.Ajay Babu, learned Assistant Government Pleader, on written instructions, submits that certain suspicious amounts were credited into the petitioner’s account. Therefore, Respondent No.3 was directed to place a lien over the account. 4. The petitioner is a widow and maintains the said account with Respondent No.3 for the purpose of receiving her pension. Since she is innocent and the account is primarily meant for her pension and other lawful entitlements, there was no justification for the respondents to impose a lien on the entire account. If any suspicious transactions are noticed in the account, other than her pension and other lawful entitlements, Respondent No.3 may place a lien only on such amounts. 5. In view of the above, the Writ Petition is disposed of directing the Respondents No.2 and 3 not to impose a lien on the petitioner’s Account No.0093104000211956 in respect of her lawful pensionary entitlements. 3 Dr.
YLR, J W.P.No.3025 of 2026 Dated 11.02.2026
Any lien, if required, may be restricted only to suspicious transactions other than the pension and other lawful amounts. 6. In the result, the Writ Petition is disposed of. There shall be no order as to costs. As a sequel, Miscellaneous petitions, if any pending, shall stand closed. _________________________ DR. Y.
