This is the first bail applicant preferred by the applicant under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant, who has been arrested in connection with Crime No. 90/2025, registered at Police Station Newai, District Durg (C.G.) for the offence punishable under Section 109 of the Bhartiya Nyaya Sanhita, 2023. 2. Case of the prosecution, in brief, is that on 05.01.2025 applicant has molested the victim, which resulted as the victim has lodged a complaint before the concerned police station. On 17.04.2025 at 6:30 DEEPTI JHA Digitally signed by DEEPTI JHA 2 am, when the victim was going for her work, the applicant grabbed her with an intention to kill, where the applicant hit her on her face, head behind her right ear and hands with a cutter. Based on above facts FIR was lodged against the applicant. 3. Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated in this case. He further submits that victim was having affair with the applicant and her statement was recorded before the trial Court, wherein she has denied the allegation levelled against the applicant. He further submits that applicant is in jail since 18.04.2025, trial is likely to take some more time, therefore, he prays for grant of regular bail to the present applicant. 4. On the other hand, learned State counsel opposes the anticipatory bail application of the present applicant. 5. I have heard learned counsel for the parties and perused the case diary. 6. Considering the nature and gravity of the offence and material on record in the case diary, and the fact that the present applicant, has assaulted the victim/injured with a sharp edge weapon, as a result of which, she suffered with injuries and also undergone surgery and particularly considering the fact the statement of the victim recorded before the trial Court, wherein she denied the allegation levelled against the applicant, which goes to show that applicant has tampered with the evidence, therefore, I am not inclined to grant regular bail to the applicant. 7. Accordingly, the regular bail application of the applicant – Om Prakash Nirmalkar @ Sonu, involved in Crime No. 90/2025, 3 registered at Police Station Newai, District Durg (C.G.) for the offence punishable under Section 109 of the Bhartiya Nyaya Sanhita, 2023, is rejected.
