1. Petitioners herein seek quashing of FIR No. 804/2022 dated 22.11.2022, registered at Police Station Govind Puri, for commission of offences under Sections 498A/406/34 IPC, along with all consequential proceedings arising therefrom, on the basis of compromise arrived at between the parties. 2. The marriage between complainant (respondent No.2 herein) and petitioner No.1 was solemnized on 27.02.2020, as per Hindu rites and ceremonies. There is no child born from such wedlock. However, on account of temperamental and irreconcilable differences, the parties started residing separately and when a complaint was lodged by respondent No.2, it resulted into registration of the abovesaid FIR. 4. Charge-sheet has already been filed. 5. Fortunately, both the parties have entered into comprehensive Settlement Deed dated 01.05.2025 and have amicably resolved all their disputes and have also agreed to part ways in a graceful manner. 6. Copy of such Settlement Deed is already on record. 7. It is in the abovesaid backdrop that quashing is being sought. 8. Respondent No.2 is present in Court and has been duly identified by the Investigating Officer (I.O.) as well as by her counsel. 9. When asked, Respondent No.2 reiterated the terms of such settlement and there is already a divorce between them by way of mutual consent on
03.11.2025. She submits that in terms of settlement, she has agreed to accept total amount of Rs. 15,00,000/- in lieu of alimony, istridhan, maintenance for self (past, present and future). She states that she has already received a sum of Rs. 10,00,000/- at the time of recording of her statement in relation to grant of divorce by mutual consent and the balance amount of Rs. 5,00,000/- has also been transferred to account of respondent No.2 through RTGS.
She submits that she is left with no other grievance against the petitioners and has entered into the abovesaid settlement out of her own free will, without any coercion and influence from any corner whatsoever and, therefore, she would have ‘no objection’ if FIR in question is quashed. 10. In view of the settlement arrived at between the parties, continuing with criminal proceedings would serve no useful purpose, especially, when dispute does not involve any public interest and is, primarily, private in nature. case, even the complainant does not wish to press any charges against the petitioners. 11. Accordingly, exercising inherent powers vested in this Court under Section 528 of the BNSS, it is deemed appropriate to quash the instant FIR. 12. Consequently, to secure the ends of justice, FIR No. 804/2022 dated 22.11.2022, registered at Police Station Govind Puri, for commission of offences under Sections 498A/406/34 IPC, along with all consequential proceedings emanating therefrom, is hereby, quashed. 13. Settlement Deed dated 01.05.2025 and original affidavit of the parties, copies of which have been placed on record in the present proceedings, shall be submitted before the learned Trial Court within further four weeks so that these become part of Trial Court Record. 14.
