CORAM: HONOURABLE MR. JUSTICE ARUN KUMAR JHA ORAL ORDER 2 12-05-2026 Heard learned counsel for the petitioner and learned APP for the State.
2. In the present case, the petitioner seeks bail in connection with Biraul P.S. Case No. 487 of 2025 registered for the alleged offence under Sections 329(3), 126(2), 115(2), 109, 117(1), 352, 351(2), 3(5) of BNS.
3. As per prosecution case, the petitioner and other co- accused persons assaulted the informant and his brother with iron rod, sticks, farsa etc. and fractured their different body parts.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. The petitioner is 73 years old person and the allegations are not believable. The present case is counterblast of Biraul P.S.
Patna High Court CR. MISC. No.29470 of 2026(2) dt.12-05-2026 2/3 Case No. 477 of 2025, which has been instituted against the informant’s side by the wife of co-accused Saddam Ansari. The allegation against the petitioner is general and omnibus along with a number of co-accused persons. The learned counsel further submits that no injury report has been brought on record and this shows falsity of allegation. Further, the FIR has been registered after a delay of 7 days, which has not been explained. The petitioner is in custody since 02.02.2026 and is having clean antecedent. The charge sheet has been submitted.
5. Learned APP for the State opposes the submission made on behalf of the petitioner.
6. Having regard to the facts and circumstances and
submissions made on behalf of the parties and considering the age of the petitioner and nature of allegation and further considering the period of custody of the petitioner and submission of charge sheet along with his clean antecedent, the petitioner above named is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Biraul, Darbhanga/court concerned in connection with Biraul P.S. Case No. 487 of 2025, subject to the conditions mentioned in Section 480(3) of BNSS
Patna High Court CR. MISC. No.29470 of 2026(2) dt.12-05-2026 3/3 and the following conditions: (i) One of the bailors will be a close relative of the petitioner. (ii) The petitioner will remain present on each and every date fixed by the court below. (iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the court concerned.
