JUSTICE SHIVASHANKAR AMARANNAVAR ORAL ORDER This petition is filed by accused No.2 under Section 483 of BNSS praying to grant bail in Crime No.20/2023 of Chikkmagaluru Rural Police Station registered for offences punishable under Sections 457 and 380 of IPC pending in C.C.No.1548/2023 on the file of I Additional Senior Civil Judge and JMFC, Chikkmagaluru. 2. Heard learned counsel for the petitioner and learned High Court Government Pleader for the respondent –State. 3. A case has been registered against unknown persons in Crime No.20/20233 of Chikkmagaluru Rural Police Station for offences under Sections 457 and 380 of IPC. After investigation, charge sheet has been filed against petitioner and another for the said offences. In the charge sheet, it is mentioned that the petitioner has been - 3 - HC-KAR NC: 2026:KHC:9632 CRL.P No. 14351 of 2025 arrested and released on police bail. After filing the charge sheet, case has been registered against the petitioner in C.C.No.1548/2023. The summons has been issued to the petitioner. The summons came to be served on the petitioner on 28.06.2024. In spite of service of summons, the petitioner has not appeared before the Court. Therefore, NBW has been issued against the petitioner. The NBW has been re-issued from time to time. The petitioner has been secured on 31.07.2025 by executing NBW issued against him. Since then he is in judicial custody. It is submitted by learned counsel for the petitioner that the petitioner could not appear before the Court due to his ill-health. The petitioner has now deposited Rs.10,000/- towards expenses to secure his presence by issuing NBW on 10.02.2026 in C.C.No.1548/2023. The said amount deposited by the petitioner requires to be appropriated to the State. The petitioner has now undertaken to appear before the Court on all dates of hearing and abide by any conditions to be - 4 - HC-KAR NC: 2026:KHC:9632 CRL.P No. 14351 of 2025 imposed by this Court. Offences alleged against the petitioner are not punishable either with death or imprisonment for life. Considering the above aspect, the petitioner has made out case for grant of bail with conditions. 4. In the result, the following ORDER i) The petition is allowed. ii) The petitioner –accused No.2 is granted bail in Crime No.20/2023 of Chikkamagaluru Rural Police Station pending in C.C.No.1548/2023 on the file of I Additional Senior Civil Judge and JMfC, Chikkamagaluru subject to following conditions: a) The petitioner –accused No.2 shall execute a personal bond for a sum of Rs.1,00,000/- with one surety for the like sum to the satisfaction of the trial Court. - 5 - HC-KAR NC: 2026:KHC:9632 CRL.P No. 14351 of 2025 b) The petitioner –accused No.2 shall not tamper the prosecution witnesses either directly or indirectly. c) The petitioner –accused No.2 shall attend the trial Court on all dates of hearing unless exempted and co-operate for speedy disposal of the case.
