THE STATE OF ANDHRA PRADESH, BY SHO, KADIRI RURAL POLICE STATION, SRI SATYA SAI DISTRICTREP. BY PUBLIC PROSECUTOR, HIGH COURT OF AP AT AMARAVATHI. ...RESPONDENT/COMPLAINANT Counsel for the Petitioner/accused: 1. P SRAVAN KUMAR REDDY Counsel for the Respondent/complainant: 1. PUBLIC PROSECUTOR The Court made the following: 2 THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA CRIMINAL PETITION NO: 741 of 2026 ORDER:- The Criminal Petition has been filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 by the Petitioner/Accused No.1 for grant of anticipatory bail in connection with Crime No.3 of 2025 of Kadiri Police Station, Sri Sathya Sai District, registered for the offence punishable under Sections 179, 318(4) read with 3(5) of the Bharatiya Nyaya Sanhita, 2023. 2. Case of the prosecution, in brief, is that, on 07.01.2025 at about 05.45 AM., at the Market Yard, Kummaravandlapalli Village, Kadiri Mandal, two accused persons purchased two rams (male sheep) from the defacto complainant by giving fake currency notes of Rs.32,000/- with intent to cheat him and went away. After some time, the defacto complainant came to know that the said currency notes were fake and he searched for the accused in and around the market yard, but in vain. Based on the report, the police registered a case against the petitioner. 3. Heard learned counsel for the Petitioner and the learned Assistant Public Prosecutor representing the Respondent-State. 4. Learned counsel for the Petitioner would submit that basing on the confessional statement of A2 to A5, the name of the petitioner/accused No.1 is figured in the present crime. Learned counsel would further submit that there are no criminal antecedents against the petitioner. It is alleged that A2 to 3 A5 purchased two sheep from the defacto complainant by using alleged counterfeit currency. Learned counsel would further submit that the petitioner is innocent and is working in a private company, he is ready to furnish sureties to the satisfaction of the Court. Learned counsel finally prays to allow the petition. 5. Per contra, learned Assistant Public Prosecutor vehemently opposed the petition by stating that serious allegations are made against the petitioner that A2 to A5 secured the said counterfeit currency from A1 only. It is observed that the custodial interrogation of the petitioner is required in this matter and the investigation is at a nascent stage and therefore, the petitioner herein does not deserve for anticipatory bail and hence, prays for dismissal of the petition. 6. Considering the submissions made and on perusal of the material on record, it is noticed that a Coordinate Bench of this Court vide order dated 28.03.2025 in Crl.P.No.2760 of 2025 dismissed the earlier anticipatory application of the petitioner. To entertain the present anticipatory bail application of the petitioner, there is no change of circumstances from the date of dismissal of the earlier bail application, as rightly put by the learned Assistant Public Prosecutor. The allegations made against the petitioner is that he provided fake currency to A2 to A5 in order to circulate the same in the public, which is a serious offence, impacting of integrity of financial systems in the country. In the said facts of the case, it is not a fit case for grant of anticipatory bail to the petitioner. 4 7. Accordingly, the Criminal Petition is dismissed. As a sequel, miscellaneous applications pending, if any, shall stand closed. ___________________________________ DR.VENKATA JYOTHIRMAI PRATAPA, J Date:09.02.2026 KNN 5 462 THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA CRIMINAL PETITION NO:741 of 2026 09.02.2026 KNN
