...RESPONDENT(S): Petition under Article 227 of the Constitution of India, praying that in the circumstances stated in the grounds filed herein, the High Court may be pleased to allow the civil revision petition directing the Hon'ble Principal Junior Civil Judge, Bapatla to hear and dispose of the main suit in O.S.No.174 of 2014 as expeditiously, as expeditiously as possible and pass Counsel for the Petitioner:
1. BHARGAV THIMMARAJU Counsel for the Respondent(S):
1. 3
The Court made the following ORDER:
The respondents 1 and 2 had filed O.S.No.174 of 2014 against the petitioner herein and three other defendants, before the Principal Junior Civil Judge, Bapatla for permanent injunction restraining the petitioner herein and other defendants from interfering with the possession claimed by the respondents 1 and 2 over the suit schedule property consisting of Ac.1-00 of wet land in East Bapatla Village. 2. The petitioner has now approached this Court with the contention that the said suit, which has been filed 11 years back, has not been disposed of and that the petitioner was entitled for early disposal of the said suit inasmuch as she was aged 60 years at the time of filing of suit and she is presently aged about 71 years, and that the pendency of the suit has cast a cloud over the said property. 3.
The pendency of the suit for injunction, for a period of 11 years entitles the petitioner to approach this Court for an early disposal of the suit. Further, the petitioner who is a Senior Citizen is also entitled to obtain priority over the other cases on account of her age also. 4. As the disposal of the said revision petition is only with a direction to dispose of the suit at an early stage, no prejudice would be caused to the respondents. Hence, notice to the respondents is waived. 4
5. Accordingly, this Civil Revision Petition is allowed, directing the learned Principal Junior Civil Judge, Bapatla to dispose of O.S.No.174 of 2014 at the earliest and within a period of six (6) months from the date of receipt of this order. There shall be no order as to costs. As a sequel, pending miscellaneous applications, if any, shall stand closed. ________________________ R. RAGHUNANDAN RAO, J
