26.09.2019.

474 IPC and also on the point of inadequate sentence for the other offences for which he had been held guilty, the concerned complainant also filed an appeal, which was registered as CA No.5/2021
8. Evidently, the abovesaid appeals are pending for quite some time.
9.
Learned counsel for the petitioner submits that on various previous occasions, the arguments were heard at length and the matters were even reserved for judgment but there was no pronouncement of final order.
10. It is submitted that both the abovesaid appeals are now coming up for
consideration before learned First Appellate Court on 24.08.2026. It is also apprised that, in the interregnum, on account of transfer, the Presiding Officer of such Court has changed.
11. The appeals are old as first such appeal was filed in the year 2019.
12.
Learned counsel for respondent No.2 submits that on 24th instant, he would not be available and would move appropriate application in this regard before the learned First Appellate Court but assures that thereafter, he would render full cooperation to the learned First Appellate Court so that the learned First Appellate Court is in a position to achieve expeditious disposal of the appeals in question.
13.
Learned counsel for both the parties thus assure that there would not be any delay or inaction on their part and would render their best assistance and cooperation to the learned First Appellate Court.
14. Keeping in mind the overall facts of the case and the assurances given by the learned counsel for the parties, the present petition is disposed of with request to learned First Appellate Court to make best endeavour to dispose of the abovesaid two appeals as expeditiously as possible and, preferably, within a period of six months from the date these are taken up by the Court.
