And In the matter of : Lokman Sk. ……Petitioner. Mr. Prabir Majumder Mr. S. Majumder Mr. Debraj Shil Ms. Anindita Kundu ……for the Petitioner. Ms. Manisha Sharma Mr. Nirupam Dhali ……for the State. Ms. Suchismita Dutta .....for the de-facto complainant. Learned advocate appearing for the petitioner prays for bail as the petitioner is in custody for more than 16 months. Learned advocate submits that there is no possibility of the trial being completed in near future, as such the petitioner may be released on bail. Learned advocate for the State has submitted the evidence of the victim. At the time of commission of the alleged offence victim was for about four years, although, the examination of the victim is over. I have taken into account the statement of the victim including the medical report in the present case and having 2 considered the same, I am of the view that this is not a fit case for releasing the petitioner on bail. It has been informed that nine more witnesses are required to be examined. In view of the aforesaid, I direct the learned trial Court to fix schedule of three dates and put in efforts so that within a reasonable period of time the evidence of the case is over. Pursuant to the service effected by the State, learned advocate for the de-facto complainant is present and has also opposed the prayer for bail. Having regard to the totality of the circumstances, the prayer for bail of the petitioner in CRM (M) 2113 of 2025 is dismissed. Report submitted by the State be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
