The petitioners are apprehending their arrest in connection with Jogta P.S. Case No.06 of 2026, for the alleged offences registered under Sections 126(2), 115(2), 121, 132, 308(4), 352, 351(3) and 3(5) of Bharatiya Nyaya Sanhita, 2023 pending in the Court of learned Judicial Magistrate 1st Class, Dhanbad. 3. Learned counsel appearing for the petitioners submits that the petitioners have been falsely implicated in this case and the allegations are made that when officials of BCCL have reached to the spot for constructing the road these petitioners have obstructed the work and apart from that there is no allegation. He further submits that there are general and omnibus allegation against all the accused persons. On these grounds, he submits that anticipatory bail may kindly be granted. 4. Learned counsel appearing for the State and Informant jointly opposed the prayer and submits that in the work of BCCL obstruction has been made by the petitioners and assault has also been made and in view of that anticipatory bail may kindly be rejected. 5. Looking into the contents of the FIR it transpires that the scuffle took place while the officials went on the spot for doing necessary maintenance work of the road and the petitioners are said to be obstructed the work, however, there are general and omnibus allegation against all the accused persons except petitioner No.2 namely Rahul Vidrohi @ Rahul Kumar who has taken out the pistol and threatened and in that view of the matter I am not inclined to provide anticipatory bail to the petitioner No.2 namely Rahul Vidrohi @ Rahul 2026:JHHC:16409 --3-- A.B.A. No. 2909 of 2026 Kumar and further in the later part of the FIR the allegation is also there against petitioner No.1 namely Sukhdeo Vidrohi @ Sukhdev Vidrohi of threatening and it has been pointed out by learned counsel appearing for the State and Informant jointly that he is having eight criminal antecedents and in view of that I am not inclined to provide anticipatory bail to the petitioner No.1 namely Sukhdeo Vidrohi @ Sukhdev Virodhi. Hence, the prayer for anticipatory bail of the petitioner Nos.1 and 2, above named, are hereby rejected. 6. So far petitioner Nos.3 to 9 are concerned, there are general and omnibus allegations against them and the allegations of assault are not there against them and in view of that I am inclined to provide anticipatory bail to the petitioner Nos.3 to 9. 7. Accordingly, the petitioner Nos.3 to 9, above named, are hereby directed to surrender before the learned Court within three weeks from today, and in the event of their surrender/arrest, petitioner Nos.3 to 9, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each, with two sureties of the like amount each, to the satisfaction of learned Judicial Magistrate 1st Class, Dhanbad in connection with Jogta P.S.
