1. By way of the present writ petition, the petitioner seeks following reliefs:
“a. Issue an appropriate writ, order or direction, more particularly in the nature of a Writ of Mandamus, directing the Respondent No. 1 (Government of NCT of Delhi), to forthwith process, decide, and release the ex-gratia compensation of Rs. 1,00,00,000/- (Rupees One Crore Only) to the Petitioner, being the widow and lawful dependent of the Deceased Late Sh. Tare, in terms of Cabinet Decision No. 2835 dated 13.05.2020 as amended vide Cabinet Decision No. 3065 dated 31 01.2022; b. Issue an appropriate writ, order or direction directing Respondent No. 2 (Municipal Corporation of Delhi) and Respondent No. 3 (Municipal Corporation of Delhi, Rohini This is a digitally signed order. Direct the respondent no. 2 and 3 to release all pending service dues, including GPF, death Gratuity and any other entitlement due to the petitioner and her family. d. Award interest @ 18% p.a. on the ex-gratia amount of Rs. 1,00,00,000/- payable by the respondent no. 1 and the additional MCD compensation of Rs. 10,00,000/- payable by the respondent no 2 and 3 from the respective dates of entitlement till the date of actual realization, in the interest. of justice;...”
2. Issue notice. The learned counsels accept notice on behalf of the respondents i.e. GNCTD and MCD.
3. This Court notes that the matter regarding payment of compensation has been pending for the last several years and the concerned officers of Government of NCT of Delhi (hereafter „GNCTD‟) and the Municipal Corporation of Delhi (hereafter „MCD‟) have not yet decided the claim of the petitioners.
4. In these circumstances, the Chief Secretary of GNCTD as also the Commissioner of MCD are directed to depute responsible officers, who will interact with each other and process the case of the petitioner for grant of ex- gratia compensation to the family of the deceased, and in case the petitioner qualifies (as per rules) for grant of such compensation, the same shall be disbursed to the concerned family members of the deceased within a period of eight weeks from today.
5. The petition is disposed of in the above terms.
