1. Applicant, who is facing murder trial in case arising out of FIR No. 307/2021, Police Station Hazrat Nizamuddin, seeks interim bail for a period of three months.

Learned counsel for applicant, in all fairness, submits that on various previous occasions also, applicant has been enlarged on interim bail. He, however, submits that interim bail was granted keeping in mind his poor medical condition and as per latest medical report also, he requires multiple surgical interventions.

Record indicates that on 19.01.2026, applicant was granted bail by this Court while keeping in mind his medical condition and such bail was for a period of one month and was extended lastly on 15.04.2026. surrendered and is in Jail.

Learned counsel for applicant submits that his period of incarceration is already beyond three years and he has never misused the liberty granted to him earlier. 5. Latest medical report dated 08.08.2026 has been received from Jail and relevant portion of such report reads as under:-
“At present, inmate patient is under supervision of CJ-01 Dispensary with complaints of CSOM, Left Chronic Otitis Media, Hiatus Hernia, Pan Gastritis, left ear discharge, Low Back Ache with Radiculopathy, tiredness, breathing difficulty, pain abdomen and Bleeding P/R. He had fresh episodes of vomiting with blood on 26.07.2026 and he was managed conservatively on medications. Patient already being advised multiple surgical intervention i.e. gall bladder stone surgery, left revision Tympanoplasty from RML Hospital and Hiatus Hernia from GB Pant Hospital, for which inmate patient is receiving possible treatment through Jail Dispensary, even after this patient is still reporting no desired response with ongoing treatment.”
6. Clearly, the medical condition of the applicant is not very good and he has already been recommended multiple surgeries. 7. Keeping in mind his aforesaid medical condition, applicant is granted interim bail for a period of six weeks with the following conditions:- (i) Applicant shall furnish a personal bond in the sum of Rs. 20,000/- (Rupees Twenty Thousand Only) with one sound surety of the like amount to the satisfaction of the learned Trial Court. (ii) He shall furnish his mobile number to the Investigating Officer and will keep the mobile operational at all times and will contact the IO telephonically once in three days; (iii) He shall not tamper with the evidence or otherwise indulge in any act or omission that is unlawful or would prejudice the proceedings in the pending trial and will not extend any threats or inducements to the witnesses and/or any other person(s) connected with the case and/or come in contact with them; (iv) He shall not try to contact, threaten, intimidate or influence any witness, directly or indirectly. (v) He shall not leave Delhi/NCR during the period of interim bail without permission of the Trial Court; and (vi) Upon expiry of the period of interim bail, he shall surrender forthwith before the concerned Jail Superintendent. 8. Application stands disposed of in the aforesaid terms. 9. Other pending applications also stand disposed of in aforesaid terms. 10.
