JUSTICE S VISHWAJITH SHETTY - 3 - HC-KAR NC: 2026:KHC:24669 WP No. 14811 of 2026 ORAL ORDER Heard the learned counsel appearing for the petitioner and learned Additional Government Advocate appearing on behalf of respondents No.1 to 4. 2. Petitioner is before this court under Article 226 of the Constitution of India seeking for the following reliefs: "i. Issue a writ in the nature of mandamus directing the 4th respondent shall register a Criminal Case against 5th Respondent forthwith vide annexure-A dated 28.04.2026. ii. Issue a writ in the nature of mandamus directing the 4th Respondent shall tract out the whereabouts of two minor children Aditya aged about 5 years, and Gowthami female aged about 3 years forthwith. iii. Issue a Writ, or order or direction as this Hon'ble Court deems fit under the circumstances of case in the interest of justice and equity." 3. Perusal of the complaint at Annexure A would go to show that there is no mention about kidnapping the children of the petitioner either by her husband or by anybody else. - 4 - HC-KAR NC: 2026:KHC:24669 WP No. 14811 of 2026 4. Under the circumstances, The petitioner is not entitled for the relief as sought for. 5. Therefore, this writ petition is disposed of reserving liberty to the petitioner to submit an appropriate complaint before the jurisdictional police, who shall receive the same and take appropriate action in accordance with law.
