Das, A.P.P. --- 2/08.06.2026 Heard Ms. Shabina Perween, learned counsel appearing for the appellant and the learned A.P.P. appearing for the NIA. This appeal is directed against the order dated 04.04.2026 passed in Misc. Cr. Application No. 502 of 2026 arising out of R. C. Case No. 11 of 2017/NIA/DLI corresponding to Bundu P. S. Case No. 65 of 2008 by the learned Additional Judicial Commissioner XVI cum Special Judge for NIA cases, Ranchi whereby and whereunder the prayer for bail of the appellant has been rejected. It has been alleged that on 09.07.2008, then then sitting M.L.A. Ramesh Singh Munda had gone to Bundu High School to attend the prize distribution ceremony and at the end of his speech, he was shot by a group of extremists and in course of indiscriminate firing, four persons were killed including the sitting M.L.A. as well as his bodyguard. Based on the aforesaid allegations, Bundu P. S. Case No. 65 of 2008 was instituted for the offences under Sections 302/379/120(B) & 34 of I.P.C., Section 27 of the Arms Act and Section 17 of the C.L.A. Act. The investigation was taken over by the NIA and case was re-registered as NIA Case No. 1 of 2017. It has been submitted by the learned counsel for the appellant that the appellant in course of trial had turned approver and his evidence has also been recorded. He has further been submitted that the appellant is in custody since 08.07.2016. -2- Mr. A. K. Das, learned A.P.P. for the NIA submits that since the approver has already been examined and considering his period of custody, he may be released on bail. In view of the fact that the appellant has turned approver and his evidence has also been recorded and considering the fact that he is in custody for a decade which has not been properly been considered by the learned trial court, we while setting aside the order 04.04.2026 passed in Misc. Cr. Application No. 502 of 2026 by the learned Additional Judicial Commissioner XVI cum Special Judge for NIA cases, Ranchi, direct that the appellant above named be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each, to the satisfaction of the learned Additional Judicial Commissioner XVI cum Special Judge for NIA cases, Ranchi in connection with R.
