Gayathri ..Respondent(s) __________ Page1 of 6 https://www.mhc.tn.gov.in/judis WP No. 12790 of 2026 PRAYER – This Writ Petition is filed under Article 226 of the Constitution of India, seeking a Writ of Mandamus, directing the 1st and 2nd Respondents namely the Tahsildar and the Sub -Registrar concerned not to entertain accept or register any document in respect of the including lands in Survey No.118/2 measuring 1 Acres and 40 cents and Survey No.123B/1A1 measuring 15 cents kettavaram Palayam Village, Kalasapakkam Taluk, Tiruvannamalai District, insofar as it relates to creation of further encumbrance and consequently not to effect any mutation or alternation in the revenue records in respect of the said property. For Petitioner(s): Mr.A.K.Rajaraman For Respondent(s): Mr.P.Harish, Government Advocate (For R1 & R2) Mr.V.Meganathan, Government Advocate (For R3) O R D E R This Writ Petition has been filed to direct the 1st and 2nd respondents not to register any document pertaining to the property morefully disclosed in the prayer to the Writ Petition without hearing the objections of the petitioner. 2.According to the petitioner, the private respondents 4 to 6 do not have any legal right to deal with the property morefully disclosed in the prayer to this Writ Petition. According to the petitioner, he had given a representation to the respondents 1 and 2 requesting them not to register any document for __________ Page2 of 6 https://www.mhc.tn.gov.in/judis WP No. 12790 of 2026 registration presented by the respondents 4 to 6 in respect to the property morefully disclosed in the prayer to this Writ Petition. According to the petitioner, despite the same, the petitioner apprehends that the respondents 1 and 2 may register the documents presented by the private respondents namely the respondents 4 to 6, for registration. 3.Mr.P.Harish, learned Government Advocate, accepts notice for the respondents 1 & 2 and Mr.V.Meganathan, learned Government Advocate accepts notice for the 3rd respondent. 4.On instructions, the learned Government Advocate appearing for the respondents 1 and 2 would submit that till date a formal protest petition has not been filed by the petitioner with the 2nd respondent. He would submit on instructions that once a protest petition is filed, the petitioner will be heard before any document is registered at the behest of the respondents 4 to 6 or any other third party in respect of the property morefully disclosed in the prayer to this Writ Petition. 5.Learned counsel for the petitioner, on instructions, would submit that the petitioner is willing to submit a protest petition with the 2nd respondent __________ Page3 of 6 https://www.mhc.tn.gov.in/judis WP No. 12790 of 2026 within a time frame to be fixed by this Court. Since, no adverse orders are passed as against the respondents 4 to 6, notice to the respondents 4 to 6 is dispensed with by this Court in this Writ Petition. 6.Accordingly, this Writ Petition is disposed of by directing the petitioner to submit a protest petition with the 2nd respondent pertaining to the property morefully disclosed in the prayer to this Writ Petition, within a period of one week from the date of receipt of a copy of this order. On receipt of the said protest petition within the stipulated time, the 2nd respondent shall, whenever any document is presented for registration by the private respondents namely the respondents 4 to 6 or any other third party pertaining to the property morefully disclosed in the prayer to this Writ Petition, issue notice to the petitioner and only after hearing the objections of the petitioner, shall take a final decision as to whether the document presented for registration by the respondents 4 to 6 or any other third party can be registered or not. However, there shall be no order as to costs.
