Tiwari, Advocate For the Informant : Mr. Hadish Ansari, Advocate --- 05/09.06.2026 1. Heard the learned counsel appearing on behalf of the parties. 2. Learned counsel for the petitioner submits that the petitioner is in custody since 13.02.2026 in connection with Nawa Bazar P.S. Case No. 01 of 2026, for the alleged offence registered under Sections 85, 80(2) and 3(5) of Bhartiya Nyaya Sanhita, 2023 pending in the court of learned Judicial Magistrate Palamau. 3. Learned counsel for the petitioner submits that there was matrimonial discord and earlier a case was registered in Mahila Thana on 12.10.2025 regarding torture and demand of dowry which ended in a compromise and after 2½ months from compromise, the victim died due to electrocution. Learned counsel submits that there is no ante- mortem injury and apparently it is an accidental death. 4. Learned counsel for the informant has opposed the prayer and has submitted that there was continuous demand of dowry and torture upon the victim and she died within seven years of marriage in her matrimonial home. Under such circumstances, the petitioner may not be released on bail. He has also submitted that even the wire through which the victim was allegedly electrocuted has not been recovered from the place of occurrence which goes to show that the accused persons have tempered with the evidence. 2026:JHHC:16457 2 5. Learned counsel appearing on behalf of the opposite party-State has also opposed the prayer for bail. 6. After hearing the learned counsel for the parties it is not in dispute that there was matrimonial discord which ended in a compromise and the victim was living in her matrimonial home and as per the post mortem report, the victim died due to electrocution, and no ante-mortem injury has been found. Considering the fact that the charge sheet has already been submitted, the petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Rs. Twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate Palamau in connection with Nawa Bazar P.S. Case No. 01 of 2026 on the following conditions: (i) One of the bailors would be the present pairvikar of the petitioner. (ii) The other bailor should be his close relative.
