Sri Rajesh Kumar Nishad, learned counsel for the applicants, Sri Abhishek Singh, learned counsel for the opposite party no. 2 and Sri Chavi Pal Singh, learned A.G.A. for the State are present. The present application under Section 528 of the Bharatiya Nagarik Suraksha Sanhita has been filed to quash the entire proceedings of Special Case No. 159 of 2025, arising out of Case Crime No. 278 of 2024, under Sections 363, 366, 376AB and 504 of I.P.C. and 5M/6 POCSO Act, Police Station- Jaithara, District- Etah, as well as cognizance/ summoning order dated 20.02.2025 pending in the Court of Special Judge (POCSO Act) /Additional Session Judge, Etah. Learned A.G.A. pointed out that date of birth of the victim is 01.01.2013 and the statement of the victim has been recorded before the trial court and the trial is on advance stage. After some arguments, learned counsel for the applicants does not want to press this application and wants liberty to file an appropriate application/ proceedings before the court of competent jurisdiction. Certified copy of the order may be returned to the learned counsel for the applicants after retaining a xerox thereof. In view of the above, the application is dismissed as not pressed with the aforesaid liberty.
