JUSTICE CHILLAKUR SUMALATHA - 3 - HC-KAR NC: 2026:KHC:9679 WP No. 37901 of 2025 ORAL ORDER Heard Sri.Jagan Mohan M.T., learned counsel for the petitioner. 2. In the light of the limited relief sought for, this Court is of the view that notice to respondent can be dispensed with and accordingly notice to respondent is dispensed with. 3. Seeking the Court to issue a writ of mandamus and to direct the Court of IV Additional Principal Judge, Family Court, Bengaluru, to dispose of M.C.No.6952/2022 which is pending on its file within a period of two months, this writ petition is filed. 4. Learned counsel for the petitioner states that petitioner is the husband of the respondent. Petitioner filed a petition under Section 13(1)(ia) of the Hindu Marriage Act seeking a decree of divorce. Though the petition was filed in the year 2022, till now Family Court has not even recorded the evidence of witnesses and each time, Family - 4 - HC-KAR NC: 2026:KHC:9679 WP No. 37901 of 2025 Court is adjourning the matter on one ground or the other. Learned counsel also states that without posting the case for enquiry, the case is being adjourning for years together only on hearing interlocutory applications and therefore, this writ petition is filed. Learned counsel brought to the notice of this Court the contents of the certified copy of the proceeding sheet. 5. The grounds on which adjournments are granted reveals justification in the submission of learned counsel for the petitioner to certain extent. For hearing on I.A.Nos.IV and V, the case travelled more than an year. Therefore, this Court is of the view that a direction is required be issued to the Family Court to dispose of interlocutory applications, if any, pending on merits and to take up the matter i.e. M.C.No.6952/2022 and to dispose of the same on merits time bound. Therefore, the writ petition is disposed of with the following: - 5 - HC-KAR NC: 2026:KHC:9679 WP No. 37901 of 2025 ORDER i) The Court of IV Additional Principal Judge, Family Court, Bengaluru, is directed to dispose of all pending interlocutory applications in M.C.No.6952/2022 within a period of one month from the date of receipt of copy of this order. ii) Also the Court is directed to take up the main matter i.e. M.C.No.6952/2022, record the evidence if not recorded till now and to dispose of the matter on merits as early as possible preferably within a period of six months from the date of receipt of copy of this order. iii) Registry to send copy of this order to the concerned Court forthwith. iv) As notice to respondent is dispensed with, Family Court is directed to serve copy of this order to the respondent/wife so as to put to the - 6 - HC-KAR NC: 2026:KHC:9679 WP No. 37901 of 2025 notice of respondent/wife, filing of this writ petition and disposal of the same.
