SIDDARTH C B 4 Counsel for the Respondent(S): 1. GP FOR REVENUE 2. GP FOR FORESTS 3. SODUM ANVESHA 5 The Court made the following: JUDGMENT:- (Per Hon’ble Sri Justice Cheekati Manavendranath Roy) Heard learned counsel for the appellants, learned Assistant Government Pleader for the respondents 1 to 4, learned Government Pleader for Forests for the 5th respondent and Smt.Sodum Anvesha, learned counsel for the unofficial respondents 6 to 11. 2. The appellants are third parties to the writ petition in W.P.No.26277 of 2025. Aggrieved by the interim order passed in the said writ petition directing the unofficial respondents in the writ petition not to interfere with the possession of the petitioners, the instant appeal has been preferred by the third parties. 3. Learned counsel for the appellants submits that the interim order was passed based on an earlier interim order passed in W.P.No.7210 of 2021 and after the said interim order was passed, the Tahsildar of T.Narsapuram Mandal, who is the respondent No.4 herein passed an order dated 28.01.2026 directing all parties not to enter the subject land. Therefore, it is contended that on account of the said order passed by the Tahsildar, the appellants are affected by the impugned interim order. 4. Since no interim order directing the appellants herein not to interfere with the possession of the petitioners with the subject land was passed, we are not inclined to interfere in the matter and to admit the appeal for hearing. If at all, the appellants are aggrieved by the impugned interim order passed by the learned Single Judge, the appellants are at liberty to file an application before the learned Single Judge to implead them as party-respondents in the said writ petition for redressal of their grievance. 5. Therefore, the Writ Appeal is dismissed at the admission stage. However, liberty is granted to the appellants to file an application before the 6 learned Single Judge in the above W.P.No.26277 of 2025 to implead them as respondents in the said writ petition. In view of the urgency that is urged by the learned counsel for the appellants and the orders that are passed by the Tahsildar not to enter the subject land, if the appellants file any such application for impleadment, the learned Single Judge shall consider and dispose of the same expeditiously on merits, according to law. It is made clear that we are not expressing anything on the merits of the case. There shall be no order as to costs. As a sequel, miscellaneous petitions, if any pending, shall stand closed. ________________________________________ JUSTICE CHEEKATI MANAVENDRANATH ROY _____________________________ JUSTICE TUHIN KUMAR GEDELA Date: 04.02.2026 ARR 7 155 THE HON’BLE SRI JUSTICE CHEEKATI MANAVENDRANATH ROY AND THE HON’BLE SRI JUSTICE TUHIN KUMAR GEDELA WRIT APPEAL NO: 96/2026 Date: 04.02.2026 ARR
