FA 3260/08 1 IN THE HIGH COURT OF JUDICATURE AT BOMBAY BENCH AT AURANGABAD 903 FIRST APPEAL NO. 3260 OF 2008 STATE OF MAHARASHTRA VERSUS ABHIMANYU KASHINATH CHAVAN AND ORS ... AGP for appellant/State : Mr. D.R. Korde Advocate for Respondent/acquiring body : Mr. T.B. Bhosale ... CORAM : SIDDHESHWAR S. THOMBRE, J. Dated : September 30, 2026 PER COURT :- 1. As the acquisition proceeding is initiated in the year 1989, heard finally at admission stage with the consent of learned AGP and the learned advocate appearing for acquiring body. 2. By this appeal, the appellant/State assails the judgment and award dated 11.4.2001 passed by the learned Additional District Judge, Beed in LAR No. 334/1994, whereby the learned reference court has enhanced the compensation. 3. The lands of the claimants situated at village Wadwani, Taluka Majalgaon, District Beed were acquired for Majalgaon Project. Notification under section 4 of the Land Acquisition Act came to be published on 20.4.1989. The SLAO has passed the award on 28.11.1991 and has granted rate of Rs.65/- and Rs.70/- per R. After receipt of the amount under protest, the claimants filed reference under section 18 of the Act by contending that the SLAO has granted very meager compensation. The claimants relied upon sale instance, Exh. 33, which was in respect of land from village Wadwani, by which 1 Acre land was sold for Rs.50,000/- i.e. 2026:BHC-AUG:46787 FA 3260/08 2 Rs.1250/- per R. By applying deductions, the learned reference court has granted rate of Rs.425/- per R. Therefore, after going through the impugned judgment and award of the reference court, this court is of the view that the reference court has not granted any exorbitant compensation. Hence, no case is made out for interference. The appeal is therefore dismissed. Pending civil application, if any, also stands disposed of. ( SIDDHESHWAR S. THOMBRE, J. ) ssc/
