JUSTICE SHIVASHANKAR AMARANNAVAR ORAL ORDER This petition is filed by accused No.1 under Section 483 of BNSS praying to grant bail in Crime No.127/2025 of Kesthur Police Station, Mandya, registered for offences punishable under Sections 126(2), 352, 118(1), 109, 351(2), 351(3) read with Section 3(5) of BNS. 2. Heard learned counsel for the petitioner and learned HCGP for respondent/State. 3. Learned counsel for the petitioner would contend that there are civil disputes between petitioner and the injured and other brothers and they are pending in O.S.No.190/2025 and O.S.No.177/2025. In the alleged incident, the petitioner has also sustained injury to his head and hand. He was admitted in the hospital for 3 days. The police have not received the complaint filed by the petitioner and his wife has sent complaint to the Superintendent of Police on - 3 - HC-KAR NC: 2026:KHC:10718 CRL.P No. 1251 of 2026 05.02.2026. Considering the same, there is a case and counter case and who is the aggressor has to be ascertained at trial. The injured who is admitted in hospital has been discharged from the hospital and is out of danger. The petitioner is in judicial custody since 24.12.2025 and as the charge sheet is filed, he is not required for custodial interrogation. The petitioner is aged 65 years and he is a senior citizen. If he is continued in judicial custody, it will affect his health. With this, he prays to allow the petition. 4. Per contra, learned HCGP would contend that the injured has sustained head injury and there is a fracture of right temporal bone and he was admitted in the hospital for 23 days. The injured is aged 71 years. Petitioner and the injured are brothers. If the petitioner is granted bail, there are chances of again they quarreling and assaulting each other. With this he prayed to reject the petition. 5. Having heard the learned counsels, the Court has perused the FIR, complaint and other materials placed on record. - 4 - HC-KAR NC: 2026:KHC:10718 CRL.P No. 1251 of 2026 6. The first information indicate that the petitioner, injured and the complainant are brothers. The injured is a retired employee and doing agriculture. There are civil disputes between the petitioner, injured and the first informant. O.S.No.190/2025 has been filed by the petitioner against injured and others pending on the file of Addl.Senior Civil Judge, Maddur seeking partition of the family properties. The injured and two others have filed suit in O.S.No.177/2025 seeking partition and declaration that the sale deed dated 02.09.2025 is illegal and not binding on the share of the plaintiffs. Considering the said aspect, there is a civil dispute pending between the injured and the petitioner and other members of the family. In the quarrel that took place on 20.12.2025, the petitioner is stated to have assaulted with wooden reaper on the head of the injured and caused bleeding injuries. The photographs of the petitioner are also produced which indicate that he has also sustained injuries to his head hand and he was admitted in hospital for 3 days. The wife of the petitioner has also filed complaint - 5 - HC-KAR NC: 2026:KHC:10718 CRL.P No. 1251 of 2026 with regard to the incident dated 20.12.2025 taken place at 12 noon, to the Superintendent of Police, Mandya, as the complaint filed by the petitioner has not been entertained by the jurisdictional police. Considering the said aspect there is a case and counter case and who is the aggressor is required to be ascertained at trial. Now the injured has been discharged and he is out of danger. The petitioner is in judicial custody since 24.12.2025 and as the major portion of the investigation is over, he is not required for further custodial interrogation. There are no criminal antecedents of the petitioner. 7. Considering the above aspects, the petitioner has made out case for grant of bail with conditions. In the result, the following: ORDER Petition is allowed. The petitioner is granted bail in Cr.No.127/2025 of Kesthur Police Station, subject to following conditions: - 6 - HC-KAR NC: 2026:KHC:10718 CRL.P No. 1251 of 2026 (i) The petitioner shall execute a bail bond for a sum of Rs.1,00,000/- with one surety for the like sum to the satisfaction of the jurisdictional Court. (ii) The petitioner shall not tamper the prosecution witnesses either directly or indirectly. (iii) The petitioner shall attend the trial Court on all dates of hearing unless exempted and co- operate for speedy disposal of the case.
