This is the first bail application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’) for grant of regular bail to the applicant who has been arrested in connection with Crime No.593/2025 registered at Police Station Mohan Nagar District Durg Chhattisgarh for the offence GOURI MUDALIAR Digitally signed by GOURI MUDALIAR Date: 2026.02.02 17:26:02 +0530 2 punishable under Sections 317(2), 317(4), 318(4), 111,3 (5) of BNS 2023. 2. Case of the prosecution, in brief, is that Mohan Nagar Police station registered a crime pursuant to an information passed by Bhartiya Cyber Crime Coordination Centre, which provided information of mule accounts, which were used to utilized the funds obtained through cyber frauds, according to the prosecution 22 Bank accounts of Karnataka Bank has been used as mule account for laundering of crime proceeds. The applicant has been roped in the crime on the basis of disclosure statement of co- accused. 3. Learned counsel for the present applicant submits that the applicant is innocent and he has been falsely implicated in the instant crime. He would submit that learned Court below has not considered the factual matrix of the case while deciding the bail application of present applicant and the prosecution has falsely implicated the present applicant in the instant crime. It is further submitted that present applicant is in jail since 07.11.2025 and conclusion of trial will take some time, therefore, he prays for grant of bail to the applicant. 4. On the other hand, learned State Counsel opposes the bail application. He would submit that in compliance of the Court’s order dated 03/12/2025 Investigating Officer has filed his personal affidavit wherein it is stated that during the course of investigation, 3 the memorandum statement of accused Pankaj Choubey was recorded in which who has stated that in the year 2023, he had opened his bank account in Karnakta Bank A/c. 2042500101375301, which was handed over in rent Rs. 20,000/- to his friend Rahul Yadav R/o.- Supela Bhilai who was using the same in Mahadev BookApp. On receiving such information, the police inquired about the same to the present applicant Rahul Yadav who disclosed, the said account was taken from Pankaj Choubey and utilized the same in Mahadev Book Sattaapp. It is submitted that, upon scrutiny of the said bank account, it has been revealed that a total amount of Rs. 2,78,82,934/- was credited and an amount of Rs. 2,74,74,901/- was debited therein therefore, prima facie the involvement of the present applicant/accused in the aforesaid crime has been established. Learned State counsel would further submit that charge sheet has not been filed in this case and matter is still under investigation, therefore the applicant is not entitled to be released on bail. 5. I have heard learned counsel for the parties and perused the case diary. 6. Considering the facts and circumstances of the case, further considering the fact that the applicant/accused Rahul Yadav knowingly obtained a bank account (A/c No. 2042500101375301) from co-accused Pankaj Choubey on rent for a consideration of Rs.20,000/- and used the said account for operating and 4 facilitating illegal betting activities through the Mahadev Book Satta App and scrutiny of the said account reveals suspicious transactions involving credit of Rs.2,78,82,934/- and debit of Rs.2,74,74,901/- and also considering the fact that charge sheet has not been filed in this case and matter is still under investigation, therefore, this Court is of the opinion that it is not a fit case to enlarge the applicant on regular bail. 7. Accordingly, the bail application of applicant Rahul Yadav involved in Crime No.593/2025 registered at Police Station Mohan Nagar District Durg Chhattisgarh for the offence punishable under Sections 317(2), 317(4), 318(4), 111,3 (5) of BNS 2023, is rejected. 8.
