Learned counsel for the petitioner submits that the petitioner is in custody in connection with S.T. No. 43 of 2026 arising out of Borio P.S. Case No. 77/2025 for the offence registered under Section 64(1), 352, 351(1) of BNS, now said to have been pending in the court of learned Additional Sessions Judge-I, Sahibganj. 2. Learned counsel for the petitioner has submitted that the petitioner has been falsely implicated in this case and on 26.10.2025 at 10:30 a.m., the petitioner was admitted in Community Health Centre in a semi- conscious state and then he was referred to Sadar Hospital, Sahibganj for further treatment. The learned counsel submits that the petitioner was arrested from Sadar Hospital, Sahibganj. He has also submitted that the charge-sheet has been submitted, but charge has not been framed. 3. Learned counsel for the opposite party has opposed the prayer for bail and has submitted that the incident is at 8:00 a.m. on 26.10.2025 and 2026:JHHC:16458 ) 2 there is direct allegation against the petitioner of committing rape upon the victim. 4. After hearing the learned counsel for the parties and considering the direct allegation of rape made against the petitioner, this Court is not inclined to enlarge the petitioner on bail.
