1. The applicant has preferred this application under Section 482 of Bhartiya Nagarik Suraksha Sanhita, 2023, for grant of Anticipatory Bail, apprehending his arrest in connection with Crime No.329/2025, registered at Police Station – Saraipali District – Mahasamund (C.G.) for the alleged commission of offence punishable under Sections 79 of BNS, 2023 and Section 12 POCSO Act, 2012.
2. As per the prosecution story, on 30.11.2025 the minor prosecutrix/victim has lodged the written report alleging that the applicant is running a tailoring shop beside her the house and shows VAISHALI LUCKY NAGARIA Digitally signed by VAISHALI LUCKY NAGARIA Date: 2026.01.31 10:58:41 +0530
2 his penis with intent to molest her since May 2025 and also sent obscene message on the whats app. On the basis of said report the police has registered the crime for aforesaid offences.

Learned counsel for the applicant submits that the applicant has been falsely implicated in this case.He further stated that a long- standing civil dispute exists between the current applicant and the victim's family over the land bearing survey numbers 358, 519, 668, and 684, due to which he has been falsely implicated in this case. Therefore, he prays for grant of anticipatory bail to the present applicant.

On the other hand, learned State counsel opposes the submission made by the learned counsel for the applicant and submits that the prosecutrix is a minor girl and according to the statement recorded under Section 183 of the BNSS, the applicant runs a tailoring shop next to his house and, since May 2025, the accused has been harassing him by exposing his private parts and also sending obscene messages on WhatsApp, therefore, applicant is not entitled for grant of anticipatory bail.
5. I have heard learned counsel for the parties and perused the case diary.

Considering the nature and gravity of the offence and material available on record in the case diary, looking to the age of the victim and also considering the fact that according to the statement recorded under Section 183 of the BNSS, the applicant runs a tailoring shop next to his house and, since May 2025, the accused has been harassing him by exposing his private parts and also sending obscene messages on WhatsApp, looking to the conduct of
3 the victim, as such, I am not inclined to grant anticipatory bail to the applicant.

Accordingly, the anticipatory bail application of the applicant– Mohammad Mohsin filed under Section 482 of Bhartiya Nagarik Suraksha Sanhita, 2023 involved in Crime No.329/2025, registered at Police Station – Saraipali District – Mahasamund (C.G.) for the alleged commission of offence punishable under Sections 79 of BNS, 2023 and Section 12 POCSO Act, 2012 is rejected.
8. Needless to say that the trial Court concerned is at liberty to proceed and conclude the trial expeditiously.
9. Office is directed to send a certified copy of this order to the trial Court concerned for necessary information and compliance forthwith.
