THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA CRIMINAL PETITION NO:709 of 2026
ORDER:- The Criminal Petition has been filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 by the Petitioners/Accused Nos.1 to 3 for grant of anticipatory bail in connection with Crime No.392 of 2025 of Yerraguntla U/G Police Station, Y.S.R. Kadapa District, registered for the offence punishable under Sections 118(1), 351(2) read with 3(5) of the Bharatiya Nyaya Sanhita, 2023.
2. Case of the prosecution, in brief, is that on 26.12.2005, at about 09:20 AM, near MPP School, Reddygari Veedi, Potladurthi Village, Yerraguntla Mandal, all the accused abused the defacto complainant’s brother’s son in filthy language. When the defacto complainant tried to obstruct the incident, A2 and A3 beat the defacto complainant with a rod and caused bleeding injury on the middle of his head, and all the accused further beat the defacto complainant with hands and legs and also threatened him with dire consequences.
3. Heard learned counsel for the Petitioners and the learned Assistant Public Prosecutor representing the Respondent-State.
4.
Learned counsel for the petitioners submits that the petitioners are innocent and have been falsely implicated in the present crime, and that it is a case and counter-case. The injured was discharged from the hospital on the same day, and most of the investigation has been completed. The petitioners
4
are ready to furnish sureties to the satisfaction of the Court. Learned counsel finally prays to allow the petition.
5. Learned Assistant Public Prosecutor vehemently opposed the petition and submitted that the victim in this case suffered grievous injuries and that specific overt acts are attributed to the petitioners. Learned Assistant Public Prosecutor finally prays for dismissal of the petition.
6. On hearing both sides and on perusal of the material on record, it is alleged against the petitioners that they attacked the defacto complainant keeping in view previous grudges and that the victim suffered grievous injuries. In the said facts and circumstances of the case, and in view of the prima facie allegations made against the petitioners and the nature of the offence, this Court is of the view that it is not a fit case to grant anticipatory bail to the petitioners at this stage.
7. Accordingly, the Criminal Petition is dismissed. As a sequel, miscellaneous applications pending, if any, shall stand closed. ___________________________________
