1 26-mca-180-2026.odt IN THE HIGH COURT OF JUDICATURE AT BOMBAY, BENCH AT AURANGABAD MISC.CIVIL APPLICATION NO. 180 OF 2026 Snehal Ravindra Ghuge @ Snehal Jaising Shirsat VERSUS Ravindra Mahadev Ghuge ... Advocate for Applicant : Mr. Rahul Prakash Dhase Advocate for Respondent : Mr. Swapnil A. Deshmukh ... CORAM : ROHIT W. JOSHI, J. DATED : OCTOBER 05, 2026 P.C.: 1. Present application has been filed under Section 24 of the Code of Civil Procedure seeking transfer of Hindu Marriage Petition No.51 of 2025 from the Court of learned Civil Judge Senior Division, Ambad to learned Family Court at Pune. 2. It is the case of applicant/wife that the distance between these two places is stated to be around 275 kms and that her father is a paralytic patient, her brother is a student studying at Beed. It is her contention that there is no fit person to accompany her for prosecuting the marriage petition. It is stated that the husband is a well qualified person, who was initially working with American Bank at Pune. 3. The respondent opposed the application by filing reply stating that the conduct and behavior of wife disentitle her from seeking transfer of petition from Ambad to Pune. It is stated that the wife is 2026:BHC-AUG:46484 2 26-mca-180-2026.odt threatening the husband and has got registered the offences against his distant relatives. The wife has filed affidavit in rejoinder placing on record certain documents to contend that on earlier occasions when she had been to Ambad, law and order situation arose and she was required to take police protection. Some photographs are placed on record to support the said contention. 4. The applicant/wife is a physiotherapist. She is a qualified lady. Normally, this Court would not entertain the application for transfer only on the ground that the applicant/wife is residing at Pune and distance between two places is 275 kms and there is no fit person to accompany her to travel from Ambad to Pune. The allegations of threat perception expressed in the rejoinder are supported by photographs. For the purpose of present application, it is not necessary to arrive at a conclusive and definite finding as regards threat to life and limb of applicant. Even if it is found that there is a bonafide apprehension in that regard, that by itself will suffice to order transfer of marriage petition. In view of pleadings pertaining to threat perception, I am inclined to allow transfer application since pleadings are supported by some material on record. 5. Hindu Marriage Petition No.51 of 2025 is ordered to be transferred from the Court of learned Civil Judge Senior Division, Ambad to learned Family Court at Pune. Miscellaneous Civil 3 26-mca-180-2026.odt Application is disposed of. 6. In the event the respondent/husband makes an application for appearance through video-conferencing, the same may be considered favourably and permission to appear through video- conferencing may be granted on such dates and at such stages as is deemed appropriate by the learned Family Court, Pune.
