--------
CORAM : HON’BLE MR. JUSTICE SANJAY KUMAR DWIVEDI
------ For the Petitioner : Mr. Lalit Yadav, Advocate. For the State
: Mr. B. Shastri, A.P.P. ------ 03/ 09.06.2026 Heard learned counsel for the petitioner and learned A.P.P for the State.
2.
The petitioner is apprehending his arrest in connection with Madhupur P.S. Case No. 64 of 2026, registered for the offence under Sections 69 and 89 of Bharatiya Nyaya Sanhita, 2023, pending in the court of learned Additional Chief Judicial Magistrate, Madhupur.
3.
Learned counsel appearing for the petitioner submits that in the FIR itself, it has been stated that the petitioner and the informant were in relationship since the year 2019 on the false pretext of marriage. He next submits that the petitioner is still ready to marry with the informant, however, she has refused to live in the house of the petitioner, as the petitioner is looking after his ailing mother. On these grounds, he submits that anticipatory bail may kindly be provided to the petitioner.
4.
Learned A.P.P. appearing for the State has opposed the prayer and submits that the allegations are there of establishing the physical relationship on the false pretext of marriage.

5.
Looking into the contents of the FIR, it transpires that it is an admitted position that the petitioner and the informant were in relationship since the year 2019, wherein the FIR has only been registered on 03.04.2026, which prima facie suggests that the relationship was consensual in nature. In the attending facts and circumstances of the case, I am inclined to extend the privilege of anticipatory bail to the petitioner.
6.
Accordingly, the above-named petitioner is directed to surrender before the learned Court within three weeks from today and in the event of her arrest or surrender, he shall be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Madhupur, in connection with Madhupur P.S. Case No. 64 of 2026, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
