Mr. Ratul Biswas, Mr. Koushik Chowdhury …for the DPSC, Howrah & WBBPE. 1. Affidavit-of-service filed on behalf of the petitioner is taken on record. 2. By the present writ petition, the petitioner seeks for direction upon the respondent authorities to grant inter-district transfer to the petitioner from the district of Howrah to the district of Paschim Medinipur on self-medical ground upon consideration of her representation dated 18th August, 2024. 3. The petitioner contends that she is an assistant teacher of Olanpara CONV JR Basic School, under Bagnan East Circle, District Howrah. The petitioner joined in the said school on 26th July, 2021. The petitioner is confirmed in service with effect from 26th July, 2023. The petitioner is suffering from 2 gynaecological problems as well as problem in L3 and L4 in the spine. The petitioner’s house is situated at Paschim Medinipur which is about 80 kms. away from her present place of posting. On 18th August, 2024 the petitioner made a representation before the concerned authority, however, the same is still pending consideration. Hence, this writ petition.. 4. Ms. Priyanka Saha, learned Advocate for the petitioner submits that the matter may be relegated to the appropriate authority for due consideration. 5. Learned Advocates representing appearing respondents leave the matter to the discretion of the Court. 6. It is found from the documents annexed to the writ petition at page 21 that petitioner is suffering from low back pain, nothing more nothing less. As per Rule 4(b) of the West Bengal Primary Education (Transfer of Teachers including Head Teacher) Rules, 2002, as amended, the petitioner has to complete five years of continuous service prior to seeking for transfer. The petitioner has not yet completed five years of service. In light of the above, the writ petition falls short of merit. 7. Accordingly, the writ petition being WPA No.25797 of 2025 stands dismissed. 8. Since no affidavits have been called for, the allegation made in the writ petition is deemed to be not admitted. 3 9. Interim order, if any, stands vacated. 10. All connected applications, if any, stand disposed of. 11. There shall be no order as to costs. 12. All concerned parties shall act in terms of the copy of the order duly downloaded from the official website of this Court. 13.
