By way of the present petition filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as the ‘BNSS’) read with Article 227 of the Constitution of India, the petitioners seek quashing of FIR No. 0721/2023, registered at Police Station Laxmi Nagar, District East, Delhi, under Sections 498-A/506/509/406/323/34 of the Indian Penal Code, This is a digitally signed order. The Petitioners and Respondent No.2 are present before this Court and have been duly identified by the Investigating Officer (IO) concerned. 4. Briefly stated, petitioner No. 1 and respondent No. 2 got married on 27.06.2019 according to Hindu rites and ceremonies. Owing to matrimonial discord, they started residing separately from 10.05.2021. At the instance of respondent No. 2, FIR No. 0721/2023 under Sections 498- A/506/509/406/323/34 IPC came to be registered at P.S. Laxmi Nagar, District East, Delhi against the petitioners. 5. During the pendency of the proceedings, the parties amicably resolved their disputes vide Settlement Agreement dated 22.07.2025. Pursuant thereto, their marriage was dissolved by a decree of divorce by mutual consent dated 25.10.2025. Respondent No. 2 has no surviving grievance and has no objection to the quashing of the aforesaid FIR and all proceedings emanating therefrom. 6. On a query made by this Court, respondent No. 2, who has been duly identified by the IO, categorically states that she has entered into the settlement of her own free will, without any force, coercion or undue influence. She further states that no monetary consideration was agreed to be paid under the settlement, that she has no surviving claim whatsoever against the petitioners and that she has no objection if the present FIR and all proceedings emanating therefrom are quashed. 7. Rather, continuation thereof would only perpetuate unnecessary litigation between the parties. There is no legal impediment to quashing the FIR in the facts and circumstances of the present case. 8. Accordingly, FIR No. 0721/2023, registered at Police Station Laxmi Nagar, District East, Delhi for the offences punishable under Sections 498- A/506/509/406/323/34 of IPC, and all consequential proceedings emanating therefrom, are hereby quashed. 9.
