( 1 ) wp11821.26 IN THE HIGH COURT OF JUDICATURE AT BOMBAY BENCH AT AURANGABAD 5 WRIT PETITION NO. 11821 OF 2026 MANOJ BAPURAO CHINCHOLE AND OTHERS VERSUS AGRICULTURE PRODUCE MARKET COMMITTEE THR ITS CHAIRMAN GANESH B PATIL AND OTHERS Mr. H.P. Randhir, Advocate for the petitioners. Mr. P.K. Lakhotiya, AGP for the respondent-State. CORAM : KISHORE C. SANT & JITENDRA JAIN, JJ. DATE : 29.09.2026 PC :- 01. The prayer in the petition is to direct Debt Recovery Appellate Tribunal [DRAT], Mumbai to decide the appeal filed by respondent Nos. 1 and 2 on priority basis. It is case of the petitioners that the petitioners happen to be auction purchasers of the property. In the appeal before the DRAT, they have undertaken not to create third party interest in the property purchased by them. The urgency is therefore expressed that the property worth Rs.4,29,00,000/- (Rupees Four Crores Twenty Nine Lakhs) is blocked because of this. 02. This Court finds that this petition will not be entertained as this Court does not have supervisory or superintending jurisdiction over 2026:BHC-AUG:45821-DB ( 2 ) wp11821.26 the DRAT. This Court is also not aware about pendency position of the DRAT. Under such circumstances, it would not be proper to direct the Appellate Tribunal to decide the appeal within stipulated period. It is open for the petitioner to make an application and revoke the statement/ undertaking given by the petitioners. The petitioner can file application for taking up the appeal out of turn pointing out urgency to the Appellate Tribunal. 03. In view of the above, this Writ Petition stands disposed off.
