4.
Learned counsel appearing for the State opposed the prayer and submits that the allegations are there that the petitioner has conspired with one Prawaz, who has sent link to the informant and in view of that, the prayer for anticipatory bail may kindly be rejected.
5. Considering that the petitioner has not contacted the informant for taking mobile through OLX and the informant himself has approached the shop of the petitioner and paid the amount to the person, who has sent link to the informant, however the payment was not made to the petitioner and pursuant to that, the petitioner has not handed over the mobile and other accessories to the informant and prima facie, if any cyber-crime has been made, that has been made by another person and further it has been pointed out that the petitioner is having no criminal antecedent, as disclosed in paragraph 16 of this application and in the attending facts and circumstances of the case, I am inclined to extend the privilege of anticipatory bail to the petitioner.
