Issue a writ in the nature of mandamus or any other appropriate writ, order or direction, thereby restraining the respondent No.6/financial institution from taking any punitive action against the petitioner vide loan account No.38305978245 and 38306005003 respectively Annexure-F. - 5 - HC-KAR NC: 2026:KHC:9812 WP No. 34939 of 2025 b. Issue a writ in the nature of mandamus or any other appropriate writ, order or direction to the respondent no.6/financial institution to recover the loan amount, EMI's and the interests/penalty from the respondent no.7 in terms of the Tri-Partite Agreement (Annexure- E). c. Direct the respondent No.6 to assist the respondent No.5 to rectify the CIBIL Score of the petitioner by removing the outstanding amount vide loan account No.38305978245 and 38306005003 respectively annexure-F. A memo is filed for withdrawal of the petition which reads as follows: "I Shrayansh Singh, Counsel for the petitioner, respectfully pray the leave of this Hon'ble High Court to withdraw the instant writ petition as the Hon'ble Supreme Court is already seized of the said matter vide SLP(C) No.7649/2023 in the matter of "Himanshu Singh & Others v. Union of India & Others", and the Petitioner accordingly prays for the liberty to move the Hon'ble Supreme Court in the said matter." - 6 - HC-KAR NC: 2026:KHC:9812 WP No. 34939 of 2025 The petitioner seeks leave to withdraw the petition with liberty being given to move the Apex Court asserting that a similar matter is pending with the Apex Court. This Court cannot reserve any liberty, and if the petitioner can invoke the Apex Court's jurisdiction for the present dispute, the request for withdrawal must suffice subject to orders by the Apex Court in such proceedings.
