Affidavit of service filed in Court today is taken on record. 2. The petitioner’s prayer seeking higher scale of pay is pending consideration before the Commissioner of School Education for a considerable period of time. 3. Submission of the petitioner is that teachers similarly placed as the petitioner has been given benefit of higher scale of pay; whereas the petitioner’s case has been kept pending for a long period of time. 4. Petitioner prays for a direction upon the Commissioner of School Education to consider the prayer of the petitioner for grant of higher scale of pay. 5. Without entering into the merits of the prayer of the petitioner seeking higher scale of pay, as it appears that the District Inspector of Schools, Secondary Education, Nadia has already forwarded the request of the petitioner to the Commissioner of School Education Page 2 way back in 2009, accordingly, the instant writ petition is disposed of by directing the Commissioner of School Education to consider and dispose of the petitioner’s prayer for higher scale of pay strictly in accordance with law and in line with the judgments and decisions passed by the Court from time to time and specially in the matter of Utpal Kanti Karan –Vs State of West Bengal & Ors. reported in 2024 SCC Online Cal 1274 at the earliest but positively within a period of twelve weeks from the date of communication of this order. 6. If the prayer of the petitioner is allowed, then necessary consequential steps for releasing the balance arrear payment shall be taken by the respondent authority without any further delay. 7. Learned advocate for the petitioner is directed to forward the representation dated 15th September, 2025 along with all supporting documents to the aforesaid respondent at the time of communicating the order of this Court. 8. The writ petition stands disposed of. 9. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities. (Amrita Sinha, J.)
