ORAL ORDER
In this petition, the petitioners seek the following reliefs:
“(a) Issue a writ of certiorari to quash the impugned
order dated 09/12/2025 allowed the defendant No.2/respondent No.2 herein to mark the Partition deed dated 27/02/2018 as Ex.D1 in O.S.No.11/2021 by the Senior Civil Judge and JMFC Krishnarajanagar (produced at Annexure-H) (b) Pass such other order or reliefs as this Hon’ble Court deems fit to grant in the circumstances of the above case in the interest of justice and equity.”
2. Heard learned counsel for the petitioners and perused the material on record.

Learned counsel for the petitioner submits that the petitioner is aggrieved by the impugned order marking the document styled as “Vibhaga Pathra” dated 27.02.2018 in evidence

as Ex.D-1, without considering the objections raised by the petitioners. In this context it is pertinent to note that since the document has already been marked in evidence as Ex.D-1 by the respondents, suffice it to state that the present petition can be
disposed of directing the Trial Court to consider all questions/issues pertaining to admissibility, proof, probative value, relevance etc., of the said document marked as Ex.D-1 at the time of final disposal of the suit. All rival contentions between the parties in this regard including the contentions in relation to admissibility, proof, probative value, relevance etc., of the said document at Ex.D-1 are kept open to be decided by the Trial Court at the time of final disposal of the suit and no opinion is expressed on the merits/demerits of the rival contentions.
4. Subject to the aforesaid observations and directions, the petition stands disposed of.
