GALLA SUDARSANA RAO Counsel for the Respondent(S): 1. GP FOR PANCHAYAT RAJ RURAL DEV 2. GP FOR REVENUE p. 3 SRS,J W.P.No.2603 of 2026 The Court made the following: ::ORDER :: Heard Sri Galla Sudarsana Rao, learned counsel for the petitioner, Sri P.Rajesh Kumar, learned Assistant Government Pleader for Panchayat Raj and Rural Development, for respondent No.1; Ms. P. Usha, learned Assistant Government Pleader for Revenue for respondents 2 to 4, and Ms. Kavitha, learned counsel representing Sri M. Sudhir, learned standing counsel for respondent No.5. 2. Learned counsel for the petitioner would submit that the petitioner is the absolute owner of the house bearing door No.8-104 in survey No.293, Panneerkalva residential area, Thukivakam Village, Renigunta Mandal, Tirupati District, having derived the title under a registered gift deed bearing document No.475 of 2020. While so, respondents 3 to 5 are interfering with the petitioner’s possession and enjoyment of the subject house, without following due process of law. 3. Learned Assistant Government Pleader for Revenue submitted the instructions of Tahsildar, wherein it was stated that the petitioner has two dwelling houses i.e. RCC buildings bearing door Nos.8-6/3 and 8-106/B, in survey No.293 of Thukivakam village, which is classified as ‘Gramakantam’. It is further stated that the petitioner raised a sheeted roof dwelling house in p. 4 SRS,J W.P.No.2603 of 2026 survey No. 929 (survey No. 926 as per the notice), Thukivakam village. It is stated that land to an extent of Ac.1-36 cents in survey No.929 (926 as per the notice) is classified as ‘Government Poramboke’ and registered as ‘Kaluva’. Therefore, a notice under Section 7 of the Andhra Pradesh Land Encroachment Act, 1905 (for short ‘the Act’), was issued to the petitioner vide R.O.C.No.A/34/ 2025 dated 28.01.2026 and the same was pasted to the premises. A copy of the said notice, dated 28.01.2026, is handed over to the learned counsel for the petitioner, across the bar. 4. Learned counsel for respondent No.5 would submit that respondent No.5 is not interfering with the petitioner’s possession of door Nos. 8-6/3 and 8-106/B, in survey No.293 of Thukivakam village. 5. In reply, counsel for the petitioner would contend that the petitioner filed the writ petition complaining of interference in respect of D.No. 8-6/3 and 8- 106/B in survey No. 293 of Thukivakam Village. Regarding the notice issued under Section 7 of the Act, the petitioner will initiate necessary action before the appropriate forum. 6. Thus, as seen from the material on record, the respondent authorities are not interfering with the petitioner’s residential houses bearing door Nos. 8- 6/3 and 8-106/B, survey No.293 of Thukivakam village. Further, a notice under Section 7 of the Act, was issued to the petitioner in respect of the shed raised p. 5 SRS,J W.P.No.2603 of 2026 in an extent of Ac.1-36 of land in survey No.929 (926 as per the notice). Since the respondent authorities are not interfering with the petitioner’s possession of the subject houses, keeping this writ petition pending, will not serve any purpose. 7. Given the above, this writ petition is disposed of at the admission stage with the consent of learned counsel on either side, directing respondents 3 to 5 not interfere with the petitioner’s possession over door Nos. 8-6/3 and 8- 106/B, survey No.293 of Thukivakam village, Renigunta Mandal, Tirupati District, without following due process of law. No costs.
