It is the grievance of the petitioner that respondent nos. 7 to 10 have undertaken unauthorised construction by encroaching upon a public pathway. It is alleged that, as a consequence of such construction, the petitioner’s ingress and egress to and from his residential house have been obstructed. It is further submitted that, in undertaking the said unauthorised construction, respondent nos. 7 to 10 have not obtained any permission from the Panchayat Authority. The respondents are unrepresented. From the photographs annexed to the writ petition, it appears that at the time of filing of the writ petition, the construction was ongoing. The petitioner made a representation before the Pradhan, Jagulgachi Gram Panchayat, by a letter dated November 3, 2025, seeking necessary action. However, it appears that no 2 steps have been taken pursuant to the said representation. Accordingly, the writ petition is disposed of with a direction upon the Pradhan, Jagulgachi Gram Panchayat, South 24 Parganas, to consider the petitioner’s representation dated November 3, 2025, and to pass a reasoned order in accordance with law within a period of two weeks from the date of communication of this order. Accordingly, WPA 26756 of 2025 is disposed of. Urgent photostat certified copy of this order, if applied for, be supplied to the learned advocates for the parties on usual undertakings.
