JUSTICE B M SHYAM PRASAD - 3 - HC-KAR NC: 2026:KHC:12309 WP No. 4911 of 2026 ORAL ORDER The learned counsel for the petitioner files a memo for withdrawal, which reads as under: "1. The present Writ Petition was filed on 10.02.2026 aggrieved by the daily order dated 30.01.2026 passed by the Arbitration and Conciliation Centre in A.C NO.273/2020, since there was no marking of representation of the Petitioner counsel, in the order sheet in spite of being present before the Arbitrator. And in addition, to stay the proceedings until an extension mandate was sought by the Respondent under Section 29A of the Arbitration and Conciliation Act, 1996. At the time of filing this Writ Petition, the Respondent had not filed any application seeking an extension of the arbitral mandate. 2. Subsequently on 17.02.2026 during the arbitration proceedings, it came to the Petitioner's Knowledge that the Respondent in this Filed a Commercial A.A for the extension of the mandate. The said Com.A.A No.66/2026 was filed by the Respondent before the Hon'ble Commercial Court on 11.02.2026 under Section 29A(4) of the Arbitration and Conciliation Act. (Order copy attached). 3. In light of the subsequent filing of Com.A.A No.66/2026 by the Respondent for the extension of the arbitral mandate, the Petitioner does not wish to press the present Writ Petition and seeks the leave of this Hon'ble High Court to withdraw the same. - 4 - HC-KAR NC: 2026:KHC:12309 WP No. 4911 of 2026 The Petitioner expressly reserves all rights, remedies, and contentions to be averred and raised before the Hon'ble LXXXVII Addl. City Civil and Sessions Judge (Commercial Court) in Com.A.A No. 66/2026. WHEREFORE, under these circumstances it is humbly prayed that this Hon'ble High Court may kindly be pleased to take this Memo on record and permit the Petitioner to withdraw the present WP No.4911/2026, in the interest of justice & equity."
