OF ASSAM. Advocate for the Petitioner : MR. A M KHAN, R. ALI Advocate for the Respondent : PP, ASSAM, BEFORE HONOURABLE MR. JUSTICE ANJAN MONI KALITA ORDER Date : 05-10-2026 Heard Mr. A.M. Khan, learned counsel for the accused applicant. Also heard Mr. D.P. Goswami, learned Addl. P.P. Assam appearing for the State. This is an application filed under Section 482 BNSS, 2023 praying for granting of pre-arrest bail to the accused applicant, in connection with Mererchar P.S. Case No. Page No.# 2/3 29/2026, registered under Sections 331(4)/ 303(2)/ 351(2) BNS read with Section 13(1) of the Assam Cattle Preservation Act, 2021. An FIR was lodged on 04-09-2026 by one Mofidul Islam, alleging that the accused persons including the accused applicant in the instant case on 03-09-2026, at midnight stolen one bullock from his cowshed. Inspite of search throughout the night they could not locate the same. However, on 04-09-2026 they found out that the bullock was slaughtered by the accused applicant and others and on being questioned, they did not give any reply to the same, but asked him to go away. On the basis of the FIR, police registered Mererchar P.S. Case No. 29/2026 under the aforementioned sections. Mr. Khan, learned counsel for the accused applicant submits that the case has been filed due to some family differences and the accused applicant is not involved in any kind of slaughter. He, accordingly, prays for grant of pre-arrest bail to the accused applicant. The learned Addl. P.P. Assam, on the other hand, opposes the prayer of bail. This Court has considered the submissions made by the learned counsel for the parties and considering the fact that slaughtered cow skin was found in the residence of the accused applicant, this Court is of the considered view that there is no merit in the instant case. Accordingly, the present A.B. application stands dismissed. Page No.# 3/3 JUDGE Comparing Assistant
