2.
Learned counsel for the petitioner submits that the petitioner is in custody since 13.12.2025 in connection with Chanho P.S. Case No. 181 of 2025, registered under Sections 308(5), 231, 308(4), 76, 352, 351(2)(3) and 61(2) of Bharatiya Nyaya Sanhita, 2023, now pending in the court of learned J.M.F.C., Ranchi.
3.

It is also alleged that when the informant/his son refused to act accordingly, the petitioner, in conspiracy with a woman lodged a false rape case at Bero Police Station, as a result of which the informant’s son Saddam Ansari was in judicial custody. It is also alleged that the accused along with others trespassed into the informant’s house, abused his family members, outraged the modesty of the wife of the informant and demanded extortion money for securing the release of the son of the informant and committed extortion at the gunpoint and also continuously threatened the informant of dire consequences. the co-accused.
4. The learned counsel for the petitioner has submitted that so far as rape case against the son of the informant is concerned, FRT has been submitted and the victim has lodged a protest petition which is pending
consideration.
5. The learned counsel for the petitioner also submits that so far as the antecedents of the petitioner are concerned, he has a few cases against him, but the same may not be a ground to refuse the bail in the present case. He submits that the petitioner is in custody since
13.12.2025.
6.
Learned counsel for the informant as well as State have opposed the prayer for bail and have submitted that the statement of the victim of the rape case has also been recorded in the case-diary and she is also a co-accused in the present case. They submit that as per her statement, she had lodged false case at the instance of the petitioner and other accused of the present case and had also taken money for the same. The FRT submitted in the rape case also shows that the police had also suggested for prosecution under sections 217 and 248 of the Bharatiya Nyaya Sanhita, 2023. The criminal antecedents of the petitioner reveal that he is involved in a number of cases involving extortion.
7. To this, the learned counsel for the petitioner has submitted that the very fact that victim of the rape case has filed a protest petition is in conflict to her confessional statement recorded in the case-diary.
8. After hearing the learned counsels for the parties and considering the nature of direct allegation made against the petitioner who is named in the FIR according to which the petitioner is involved in organized crime and there are numerous cases of similar nature pending against the petitioner, this Court is not inclined to enlarge the petitioner on bail and hence, this bail application is rejected.
9. Let a copy of this order be communicated to the learned court concerned through “FAX/email”.
